Constitutional Convention In session

Art. II
This Constitution may be amended only by a supermajority vote of greater than two thirds of all seats of the Bundesrat and greater than two thirds of all seats of the Bundestag . No amendment shall take effect within 2 years of any previous amendment, nor may any amendment be proposed while another remains under debate.✏️ The constitution was last changed on the 29th of September 2024 (2 months ago).
Suffrage

The Supreme Court
Art. V
The Supreme Court of Saxenheim shall be the final arbiter of the law of Saxenheim. Any party may appeal to it on the ground that a law in force is unconstitutional, that a cabinet member or the holder of an elected office is acting illegally, or that a constitutional amendment is invalid. The Court shall hear the parties of Saxenheim, and its justices shall rule by majority. Its rulings take direct effect and are not subject to appeal. 🔒

Amendments
Art. XX
The national flag of Saxenheim shall consist of a red field with a diagonal black stripe bordered in white and a central golden sun, symbolizing the strength, unity, and continuity of the nation.

The official language of Saxenheim shall be Saxic.

The national anthem of Saxenheim shall be ‘Rise of Saxenheim’.

These elements shall be recognized as fundamental symbols of the nation, and their protection and respect shall be the duty of the state and every citizen. ✏️
Art. XXI
Article I: Human Dignity & The Rule of Law

Section 1 (Human Dignity): Human dignity is inviolable. It must be respected and protected by all state authority. No individual shall be subjected to torture, cruel or degrading treatment.

Section 2 (Rule of Law): All state actions are bound by law. No one may be punished for an act that was not legally forbidden at the time it was committed. Laws must be publicly accessible, clear and applied equally to all.

Section 3 (Repudiation of War): The nation solemnly renounces war as an instrument of national policy and a means of settling international disputes. The state commits to the maintenance of a just international order based on the rule of law, the peaceful resolution of conflicts and the promotion of universal human rights.


Article II: Equality & Non-Discrimination
Section 1 (The Equality Amendment): All persons are equal before the law.

Section 2 (Comprehensive Protection): No citizen may be discriminated against, favoured or persecuted based on gender, race, national origin, language, sexual orientation, gender identity or philosophical conviction.

Section 3 (Freedom of Belief): The practice of religion and ethical belief is guaranteed. No state church shall be established, and state and religious institutions shall remain separate.


Article III: People's Power & Political Rights

Section 1 (Popular Sovereignty): All state power derives from the people. This power shall be exercised through free, fair, secret and periodic elections and referendums.

Section 2 (Freedom of Assembly & Association): All citizens have the right to form political parties, unions and associations, and to assemble peacefully without prior permission.


Article IV: Personal Liberties

Section 1 (Life and Physical Integrity): Every individual has the right to life, liberty and physical integrity. Capital punishment and torture are strictly prohibited. No one shall be subjected to medical or scientific experimentation without their free and informed consent.

Section 2 (Freedom of Conscience): Freedom of thought, conscience and inner conviction is absolute and inviolable. No one shall be compelled by the state to disclose their philosophical, political or religious beliefs, nor forced to take an oath against their conscience.

Section 3 (Freedom of Movement): All citizens enjoy the right to move freely throughout the entire territory of the state, to choose their place of residence and to leave or re-enter the country at any time. Limitations shall only be possible in the case of sanitary emergency or war, and only for the time strictly necessary. No citizen may be exiled or stripped of their citizenship.

Section 4 (Property and Inheritance): Private property and the right of inheritance are guaranteed. Expropriation of property by the state is permissible only for the public good and in exceptional circumstances, and must be authorised by law and requires prompt and fair financial compensation.


Article V: Due Process & Legal Safeguards

Section 1 (Right to a Fair Trial): Everyone is entitled to a fair and public hearing by an independent and impartial tribunal, including the right to legal counsel. The state shall provide free counsel for those in need.

Section 2 (Habeas Corpus and Presumption of Innocence): Every person accused of a crime is presumed innocent until proven guilty in a public trial. No person shall be deprived of their liberty except on such grounds and in accordance with such procedures as are established by law. Anyone arrested has the right to be informed immediately of the charges and brought before a judge within 24 hours.


Article VI: Freedoms of Mind & Communication

Section 1 (Expression and Press): Every person has the right to freely express, disseminate and publish their opinions in speech, writing and images, regardless of the medium used and whether expressed in physical spaces or through digital and electronic media.

Section 2 (Freedom of Art and Science): Art, science, research and teaching are free from state interference. The state supports and promotes scientific research and the development of arts and culture.


Article VII: Economic Freedom & Labor

Section 1 (Freedom of Enterprise): The state supports entrepreneurship and protects free market. The right to establish businesses, own private property and engage in free economic competition is guaranteed, subject to regulation only insofar as necessary for the public good.

Section 2 (Freedom of Work): All citizens have the right to freely choose their occupation, place of work and place of training. Forced labour is prohibited. No worker shall be dismissed for joining a union or expressing dissent.


Article VIII: Social State and Fundamental Protections

Section 1 (Social state): The state shall actively pursue policies to prevent extreme economic inequality and ensure that all citizens can live a life compatible with human dignity.

Section 2 (Right to assistance): Every citizen has the right to state-supported assistance in the event of involuntary unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond their control.

Section 3 (Healthcare and Housing): The state shall ensure equitable access to essential medical services and promote conditions that enable every citizen to secure adequate, affordable housing.

Section 4 (Right to Education): Education is a fundamental instrument for social mobility, equality and the development of the country. Primary and secondary education shall be free, compulsory and accessible to all. Higher and vocational education shall be equally accessible.


Article IX: Privacy, Information and Digital Rights

Section 1 (Inviolability of the Home and Communications): The private home, personal correspondence and private communications, whether physical or electronic, are inviolable.

Section 2 (Data Protection and Surveillance): Every individual has the right to the protection of their personal data. State surveillance, interception of communications, or entry into a private residence is strictly prohibited without a specific, time-limited warrant issued by an independent judge based on probable cause.


Article X: Environment

Section 1 (Ecological Protection): The state protects the natural foundations of life. Every citizen has the right to a clean, healthy and sustainable environment. The state actively regulates the industry, so as to preserve biodiversity and mitigate ecological damage. ✏️
Art. XXII
The Government shall operate according to the principle of maximum transparency and openness.

1. All ministries, public authorities, independent constitutional offices, and publicly funded bodies shall publish their decisions, expenditures, contracts, reports, and official records in a timely and accessible manner.

2. Every person has the right to access information and official documents held by public authorities without having to demonstrate a particular legal interest.

3. Restrictions on public access may only be established by law and only where they are necessary and proportionate to protect national security, the administration of justice, personal privacy, confidential commercial information, or other compelling public interests.

4. Any restriction on access shall be interpreted narrowly and remain subject to independent judicial review.

5. Transparency shall be the rule. Secrecy shall be the exception. ✏️
