Constitutional Convention

This Constitution may be amended only by a supermajority vote of greater than two thirds of all seats of the Bundesrat and greater than two thirds of all seats of the Bundestag . The Supreme Court
Art. V
The Supreme Court of Rheinland shall be the final arbiter of the law of Rheinland. Any party may appeal to it on the ground that a law in force is unconstitutional, that a cabinet member or the holder of an elected office is acting illegally, or that a constitutional amendment is invalid. The Court shall hear the parties of Rheinland, and its justices shall rule by majority. Its rulings take direct effect and are not subject to appeal. 🔒

Amendments
Art. XVI
In respect to the inviolable dignity that every human being holds, the residents of the Federal Republic of Rheinland are naturally guaranteed to universal, inalienable, and indivisible human rights. These include the (1) right to life; (2) right to liberty; (3) right to equal treatment regardless of their gender, race, religion, or other underlying factors; (4) right to an equal trial and treatment before the law under the presumption of innocence until proven guilty; (5) right to asylum and protection by and from the law; (6) right to marry out of their own will; (7) right to own property; (8) right to work of their own choice with appropriate pay; (9) right to sufficient rest and leisure; (10) right to a reasonable standard of living and social security; (11) right to education; (12) right to participate in elections upon reaching the age of majority, (13) freedom of movement, residence, and change of nationality; (14) freedom of thought, conscience, and religion; (15) freedom of opinion and expression; (16) freedom of assembly and association; and the (17) freedom to participate in government. ✏️
Art. XVII
Section 1. Public Trust.
All public office is a public trust. Officials and employees of the Government of Rheinland shall serve with integrity, accountability, transparency, and fidelity to the Constitution and laws.

Section 2. Financial Disclosure.
All elected officials, ministers, senior civil servants, and other officers as prescribed by law shall submit annual public declarations of assets, liabilities, sources of income, and financial interests. Such declarations shall be made available to the public in a manner prescribed by law.

Section 3. Prohibition on Personal Enrichment.
No public official shall use their office, authority, public funds, confidential information, or government resources for personal gain or for the unjust enrichment of any individual, organization, or entity.

Section 4. Transparency in Government Contracts.
Government contracts, procurement processes, grants, and expenditures shall be conducted openly and competitively, except where confidentiality is strictly necessary for national security or other reasons established by law.

Section 5. Independent Oversight.
An independent Anti-Corruption Commission shall be established by law and shall possess the authority to investigate allegations of corruption, abuse of office, bribery, fraud, and related offenses committed by public officials.

Section 6. Accountability.
Any public official found guilty of corruption, bribery, embezzlement, abuse of office, or other serious breaches of public trust shall be subject to removal from office, disqualification from future public office, restitution of unlawfully obtained assets, and such additional penalties as may be prescribed by law.

Section 7. Protection of Whistleblowers.
Individuals who report corruption or misconduct in good faith shall be protected from retaliation, discrimination, or adverse action, as provided by law.

Section 8. Enforcement.
The Legislature shall enact such laws as are necessary and proper to implement and enforce the provisions of this Article. ✏️
Art. XVIII
Section 1. Public Trust.
Membership in the Bundestag and Bundesrat is a public trust. No member shall use their office, authority, influence, or access to public resources for personal enrichment or unlawful advantage.

Section 2. Corruption Offenses.
For the purposes of this Article, corruption offenses shall include bribery, embezzlement, fraud against the state, abuse of public office, illicit enrichment, unlawful influence peddling, obstruction of anti-corruption investigations, and such related offenses as may be defined by law.

Section 3. Suspension Pending Proceedings.
Upon formal indictment by a competent judicial authority for a corruption offense, the respective chamber may, by a two-thirds vote of its members, suspend the accused member from voting, holding committee positions, and exercising other legislative privileges until the conclusion of judicial proceedings.

Section 4. Removal from Office.
Any member of the Bundestag or Bundesrat who is convicted by final judgment of a corruption offense shall immediately forfeit their seat, and such vacancy shall be filled in the manner prescribed by law.

Section 5. Disqualification.
Any person removed pursuant to this Article shall be disqualified from holding any elected or appointed public office within Rheinland for a period of not less than ten years. The Legislature may prescribe longer periods of disqualification for grave offenses.

Section 6. Recovery of Public Assets.
The State shall have the authority to recover public funds, property, or benefits unlawfully obtained through corruption, without prejudice to any criminal, civil, or administrative penalties imposed by law.

Section 7. Due Process and Judicial Review.
No suspension, removal, or disqualification under this Article shall occur except in accordance with due process of law. All actions taken pursuant to this Article shall remain subject to judicial review.

Section 8. Enforcement.
The Bundestag shall enact legislation necessary to implement, enforce, and give full effect to the provisions of this Article. ✏️
Art. XIX
Section 1. The Market Economy

(1) Rheinland shall be a liberal market economy, combining free enterprise, private property, and competition with social responsibility, consumer protection, and respect for human dignity.
(2) The state shall protect competition and prevent the abuse of economic power. Markets shall remain open, transparent, and accessible to all.
Section 2. Fundamental Economic Liberties
(1) Every citizen shall have the inviolable right to:
· Choose their profession, trade, or occupation freely;
· Establish, operate, and manage businesses;
· Own, use, and transfer private property, capital, and assets;
· Enter into contracts freely;
· Engage in trade, investment, and commerce.
(2) These rights shall be subject only to limitations necessary to protect public health, national security, or the rights of others. Such limitations must be proportionate and prescribed by law.

(3) No law may impose excessive, arbitrary, or retroactive restrictions on economic freedom.
Section 3. The State’s Duty to Promote Economic Development
(1) The state shall actively promote entrepreneurship, innovation, and economic development. It shall create a legal and institutional framework that encourages investment and competition.
(2) The state shall support small and medium-sized enterprises, start-ups, and family businesses, recognising them as the backbone of the economy and social stability.
(3) The state shall invest in infrastructure, education, research, and digitalisation, ensuring that all citizens have the opportunity to contribute to and benefit from economic growth.
Section 4. Economic Development as a Common Good
(1) Economic development shall be recognised as a common good of the nation. Prosperity shall be pursued in an inclusive, sustainable, and just manner.
(2) The state shall ensure that the benefits of growth are broadly shared, preventing excessive inequality and ensuring access to education, healthcare and social security. ✏️
