In a healthy constitutional democracy, the solemn power to declare war must rest with Parliament. A decision of such gravity, affecting the peace, security and future of the nation, must proceed from the legitimate authority of the people through their elected representatives, subject to full parliamentary deliberation and accountability.
At the same time, the constitutional settlement must preserve the essential powers required for the effective functioning and continuity of the State within the institutions of the Crown and the Government established by the Constitution. Such powers should not be transferred to independent state officials who exercise authority without a direct democratic mandate or an institutional responsibility to the Crown, Parliament, or the electorate.
The reform therefore seeks to maintain a clear constitutional hierarchy: Parliament determines the fundamental decision to declare war, while the Crown and the constitutionally responsible Government retain the executive authority necessary to protect the nation and conduct the affairs of the State.
