Separation of Powers Amendment: A democratic state depends not only on free elections, but also on strong institutions, clear accountability, and an effective separation of powers. This reform modernises the constitutional distribution of executive authority by assigning regulatory and oversight functions to independent public institutions where impartiality is essential, while ensuring that elected ministers remain responsible for political leadership and government policy. Independent oversight of areas such as banking regulation, monetary policy, judicial appointments, and the designation of extremist organisations strengthens public confidence, protects fundamental rights, and reduces the risk of political interference in decisions that must be guided by law rather than partisan interests. At the same time, this reform clarifies the constitutional responsibilities of the Federal Government. Ministers remain accountable for directing national policy, managing their departments, and implementing the democratic mandate entrusted to them by the Bundestag, while independent institutions safeguard the rule of law and ensure equal treatment under the Constitution. By strengthening institutional independence without weakening democratic accountability, this amendment creates a more transparent, balanced, and resilient constitutional order that better protects both the rights of citizens and the integrity of the Republic.

Amendments

Add an amendment: “Government shall operate according to the principle of maximum transparency a…”
Government shall operate according to the principle of maximum transparency and openness. 1. All ministries, public authorities, independent constitutional offices, and publicly funded bodies shall publish their decisions, expenditures, contracts, reports, and official records in a timely and accessible manner. 2. Every person has the right to access information and official documents held by public authorities without having to demonstrate a particular legal interest. 3. Restrictions on public access may only be established by law and only where they are necessary and proportionate to protect national security, the administration of justice, personal privacy, confidential commercial information, or other compelling public interests. 4. Any restriction on access shall be interpreted narrowly and remain subject to independent judicial review. 5. Transparency shall be the rule. Secrecy shall be the exception.
Government Transparency: A democracy cannot function without an informed public. Transparency enables citizens to understand how decisions are made, how public funds are spent, and whether those entrusted with public office are acting in the public interest. By establishing openness as a constitutional principle, this amendment strengthens democratic accountability, combats corruption, increases public trust, and ensures that government remains accountable to the people it serves. At the same time, it recognizes that limited exceptions may be necessary to protect national security, personal privacy, and other compelling public interests, provided such restrictions are established by law, remain proportionate, and are subject to judicial oversight.

Proposer's case

A modern democracy requires more than free elections. It requires institutions that are transparent, accountable, independent, and worthy of the public's trust. This reform package modernises Saxenheim's constitutional framework by reaffirming our democratic identity, strengthening the separation of powers, and establishing transparency as a fundamental principle of government.

By clarifying institutional responsibilities, reducing political interference in independent oversight, and guaranteeing public access to government information, these reforms strengthen the rule of law and reinforce the principle that all public authority exists to serve the people.

Together, these amendments lay the foundation for a more open, accountable, and resilient Republic, one in which democratic institutions are stronger, citizens are better informed, and government is exercised with integrity, transparency, and respect for constitutional principles.
