Rationale

For too long our nation has tried to overreach its power over their citizens. With this act we increase our citizens rights before the police, so they don't take advantage of their power, as well as maintaining the core of justice: innocent until proven guilty

Proposed Changes

1

Police Search & Seizure
Previous law
Reasonable suspicion required; warrant needed for homes and devices
Judicial warrant needed for all searches and seizures except emergencies

2

Bail & Pre-Trial Detention
Previous law
Risk assessment decides release
Presumption of release except for serious threats; cash bail abolished

Voting record

Every vote must state a public reason. Most recent first.

“ABF supports strong protections for individual liberty and due process while preserving emergency powers and detention for genuine public-safety threats.”

ASTER
Voted July 16, 2024
Yes

“ASTER votes yes. This isn't the deregulation we've opposed before, it's the opposite: less unchecked power over citizens, not less protection for them. Requiring a warrant for searches, barring emergencies, keeps the police accountable to a judge, not just to themselves. And ending cash bail fixes a system where wealth decided who stayed free before trial, not risk. Presumption of innocence should mean something more than a slogan. This bill makes it one.”
