Name of the State

The official name of the state becomes Republic of Costavela

Change from Outdated Name: The official name of the state is currently "Kingdom of Costavela" but Costavela currently has no monarchy, The official name should be changed to what it truly is: A Sovereign and Democratic Republic. That is why this amendment changes the name from "Kingdom" to "Republic," and to differentiate ourselves from the First Republic before the establishment of the Kingdom, it will be unofficially called the "Second Republic"

1. Capital of the Repúblic The city of San Montes is established as the official and permanent capital of the Second Republic of Costavela. 2. Creation of the National District The city of San Montes and its surrounding territory shall constitute the National District of San Montes, a special territorial entity separate from the other provinces of the Republic and subject to its own administrative regime established by law. 3. Local Government The National District of San Montes shall be administered by a Municipal President, elected by universal, free, direct, and secret suffrage by the citizens residing in said territory. 4. Seat of State Institutions The Government, the Congress of Deputies, the Senate, the Supreme Court, and other national institutions of the State shall be located in the city of San Montes, unless expressly provided otherwise by law.
Amendment on establishing a Capital: To establish an official national capital for the Kingdom of Costavela, providing the State with a permanent headquarters for its institutions and governing bodies. The absence of a defined capital has created a lack of territorial reference point for the exercise of state functions, making it necessary to designate San Montes as the political and administrative center of the nation

All citizens of the Republic of Costavela shall enjoy the following fundamental rights and freedoms: Title I: Fundamental Rights a) The right to life and personal integrity. b) Equality before the law without discrimination based on origin, sex, religion, political opinion, or any other status. c) Freedom of expression and opinion. d) Freedom of peaceful assembly and association. e) Freedom of worship and religion. f) The right to privacy and protection against arbitrary interference. g) The right to due process and a fair trial. h) The right to participate in the political life of the Republic in accordance with the law. 1) To vote and be elected; 2) to participate in free and periodic elections; 3) to form or join political parties; 4) to have equal access to public office. Title II: Presumption of innocence and criminal guarantees No one shall be considered guilty until a final judgment is rendered. Right to a defense and legal assistance. No one may be arbitrarily detained without clear evidence. Principle of legality in criminal law: there is no crime or punishment without a prior law. Title III: Freedom of movement Right to move freely within the territory. Right to leave and return to the country, with very specific legal exceptions. Title IV: Economic and Social Rights Right to education; Right to health; Right to work; Freedom of association; Right to decent working conditions; Protection of the family, children, and the elderly; Right to social security. Title V: Private property The right to acquire, possess, and dispose of property; no one may be arbitrarily deprived of their property; expropriation is permitted only for reasons of public utility and with just compensation. Title VI: Freedom of Information Freedom of the press; the right to seek, receive, and impart information; the prohibition of prior censorship, except for constitutionally defined exceptions. Title VII: Digital rights and data protection Protection of personal data; Inviolability of communications; Protection of digital privacy; Right to access public information. Title VIII: Protection against the power of the State Rights are directly enforceable in the courts; all authorities are obligated to respect them; laws that violate constitutional rights can be declared unconstitutional; rights can only be limited by law, in a necessary and proportionate manner. Final Clause One: Any restriction of a fundamental right must be provided for by law, pursue a legitimate aim, be necessary in a democratic society, and be proportionate to the objective pursued. Final Clause Two: No restriction may affect the essence or essential content of the rights recognized by this Constitution
Amendment on Fundamental Rights and Freedoms and of the State: The purpose of this amendment is to expressly recognize and protect the fundamental civil rights and liberties of all citizens of the Republic of Costavela. Its incorporation strengthens the rule of law, guarantees human dignity, and establishes clear limits on the exercise of public power, providing legal certainty for present and future generations

The purpose of this constitutional reform is to modernize and update the institutional framework of the Second Republic of Costavela (Formerly the Kingdom of Costavela (outdated name). The current Constitution was drafted at an earlier stage of national development and currently contains significant gaps in matters fundamental to the organization of the State, democratic representation, and the protection of citizens' rights.
